The SPA, the regulator of betting in Brazil, published Public Consultation Notice No. 3/2026 on Wednesday as it seeks to improve the regulations on betting licensing.

It provides for public consultation to obtain contributions and information to prepare a decree that will establish new rules for authorising the operation of bets in Brazil.

The measure is part of the SPA Regulatory Agenda, established by Ordinance No. 817 in April 2025. It anticipated a review of the authorisation procedure for betting operators during the first quarter of this year.

Only now has the SPA put the consultation online for such a review.

The public consultation aims to improve the authorisation request procedure, as outlined in SPA/MF Ordinance No. 827/2024. The SPA will incorporate lessons learned from the first authorisation cycle into the document. Ordinance 827 regulated articles of the betting laws regarding the rules and conditions for obtaining authorisation to operate betting establishments.

Now, the SPA has opened a consultation to gather contributions and information that will support the government in revising the ordinance with rules for authorising the operation of sports betting and online games.

The consultation will last 45 days, from 27 July to 9 September. Any individual or legal entity may participate through the Portal Brasil Participativo. To participate, those interested must access the portal using their gov.br address.

The SPA will review submissions after the contribution period ends, in accordance with Article 31 of Decree No. 12,002/2024.

Transparency in the authorisation process

The consultation on improvements to the licensing procedures arrives amid a push for greater transparency of the process.

In June, Brazil Finance Minister Dario Durigan announced the ministry would publish over 25,000 documents relating to betting licensing. Durigan said this aligned with the government’s commitment to providing transparency.

Earlier this week, the Ministry of Finance published Administrative Order No. 2,126, establishing a task force ensuring transparency in the licensing processes for gambling companies.

授权程序的透明度

此次关于改进牌照程序的咨询正值外界推动提高该程序透明度之际。

6月，巴西财政部长Dario Durigan宣布，该部将公布超过25,000份与博彩牌照相关的文件。Durigan表示，这与政府致力于提供透明度的承诺相一致。
